These Terms of Use ("Terms") apply to your access to and use of Community Pulse Hub, including the Community Pulse Hub mobile app, website, related pages, notification tools, support services, and any related features operated by BrainTech Systems, LLC / Community Pulse Hub ("Community Pulse Hub," "we," "our," or "us").
By creating an account, logging in, joining a community, accessing the app, or using Community Pulse Hub, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app or services.
1. Purpose of Community Pulse Hub
Community Pulse Hub is an optional private communication and notification hub for participating groups, communities, organizations, clubs, districts, associations, teams, and similar groups.
The app may be used to share updates, reminders, announcements, helpful links, amenity information, meeting reminders, notification preferences, and related community information.
Community Pulse Hub is provided as a convenience tool only. It is not intended to replace any official website, official notice system, emergency alert system, public records system, legal notice system, public meeting notice system, or official government communication channel.
2. Important Non-Government Disclaimer
Community Pulse Hub is not a government app and does not represent any government agency, public authority, emergency service, law enforcement agency, municipality, county, state agency, federal agency, community development district, homeowners association, management company, or other organization unless expressly stated in a written agreement with that organization.
Information shared through the app may be provided by participating groups, organizations, authorized admins, representatives, or other approved contributors. Community Pulse Hub does not guarantee that all information is complete, accurate, current, official, or suitable for your particular situation.
You should verify important information directly with the participating group, organization, official website, management company, public agency, or other appropriate source.
3. Not for Emergencies
Community Pulse Hub is not an emergency notification system.
Do not rely on Community Pulse Hub for emergencies, urgent safety alerts, law enforcement issues, fire, medical emergencies, severe weather warnings, evacuation notices, emergency instructions, or any other urgent situation.
In case of an emergency, call 911 or contact the appropriate emergency services.
4. Not for Legal Notices, Public Records, or Official Public Notices
Community Pulse Hub is not a legal notice system, public records request system, official public meeting notice system, official government notice system, or official recordkeeping system.
Do not rely on Community Pulse Hub as the only source for legal notices, official public meeting notices, government notices, public records requests, deadlines, legal rights, official agenda postings, statutory notices, compliance requirements, or other official communications.
If you need official information, you should contact the appropriate organization, public agency, official website, records custodian, management company, or legal authority directly.
5. User Accounts and Access
To use certain features, you may need to create an account, verify your email address, log in, and enter a private access code or be approved by a participating group or organization.
You are responsible for keeping your login information secure and for all activity under your account.
You agree to provide accurate information and to update your information when needed.
Private community codes, access links, or login credentials may not be shared with unauthorized users.
We may suspend, restrict, or remove access if we believe an account is unauthorized, misused, inactive, fraudulent, harmful, or in violation of these Terms.
6. Community Access and Approved Users
Access to a community, group, or organization inside the app does not guarantee membership, legal rights, residency rights, voting rights, property rights, public benefits, official status, or entitlement to services.
Participating organizations may control or request changes to user access, admin access, community codes, content visibility, and notification categories.
Community Pulse Hub may remove or limit access when requested by an authorized participating organization or when needed to protect the app, users, data, or service.
7. Push Notifications Are Not Guaranteed
Push notifications depend on many factors outside our control, including device settings, app permissions, operating system settings, internet connection, wireless carrier service, Apple services, Google services, Firebase services, third-party systems, battery settings, user preferences, and other technical conditions.
Community Pulse Hub cannot guarantee that every notification will be delivered, received, opened, read, viewed, or delivered at a specific time.
You are responsible for checking the app, official sources, and any appropriate organization or agency directly for important information.
8. Content Provided by Participating Organizations
Community Pulse Hub may display content provided by participating groups, organizations, admins, representatives, or other authorized contributors.
Such content may include announcements, reminders, links, amenity information, meeting reminders, documents, descriptions, schedules, notices, photos, or other information.
Community Pulse Hub is not responsible for the accuracy, completeness, legality, timeliness, usefulness, or availability of content provided by participating organizations or their authorized users.
Participating organizations are responsible for reviewing and approving their own content before it is published or shared through the app.
9. User Responsibilities
You agree not to:
- Use the app for unlawful, abusive, misleading, fraudulent, harmful, or unauthorized activity.
- Use the app for emergency alerts, legal notices, public records requests, official government communications, or official public meeting notices unless expressly authorized in writing by Community Pulse Hub and the appropriate organization.
- Attempt to access accounts, communities, groups, data, admin areas, systems, or features without authorization.
- Share private access codes or login information with unauthorized users.
- Upload, submit, or transmit false, misleading, defamatory, offensive, harmful, infringing, confidential, private, or unauthorized content.
- Interfere with the operation, security, performance, or availability of the app or related systems.
- Reverse engineer, copy, scrape, attack, test, disrupt, overload, or misuse the app, website, software, APIs, databases, or systems.
- Use the app in a way that violates any law, regulation, contract, community rule, third-party right, or these Terms.
10. Privacy
Your use of Community Pulse Hub is also governed by our Privacy Policy.
The Privacy Policy explains what information may be collected, how it may be used, and how account deletion may be requested.
By using the app, you agree that we may collect and use information as described in the Privacy Policy.
11. Account Deletion
You may request account deletion from inside the app or by contacting support.
Account deletion may remove your user profile, community membership, notification preferences, and app account data.
Some limited information may be retained when required or reasonably necessary for security, fraud prevention, legal compliance, backup, dispute resolution, business records, system integrity, or operational purposes.
Deleting your account may not delete content, records, or information controlled by a participating organization, public agency, management company, or third-party service.
12. App Availability and Changes
Community Pulse Hub may be updated, changed, interrupted, suspended, limited, or discontinued at any time.
Features may be added, removed, modified, delayed, or made available only to certain users, communities, groups, or organizations.
We do not guarantee that the app will always be available, error-free, secure, uninterrupted, compatible with every device, or available in every location.
We are not responsible for service interruptions, internet issues, device issues, app store issues, third-party platform issues, Firebase issues, Apple or Google service issues, maintenance, security events, or circumstances outside our reasonable control.
13. Third-Party Services and Links
The app may rely on or link to third-party services, websites, app stores, cloud services, Firebase, Apple, Google, email providers, device operating systems, maps, documents, or other third-party systems.
We do not control and are not responsible for third-party services, websites, content, availability, privacy practices, terms, errors, delays, or failures.
Links are provided for convenience only and do not mean that Community Pulse Hub approves, controls, or guarantees the linked content.
14. Intellectual Property
Community Pulse Hub, BrainTech Systems, LLC, and their licensors retain all rights, title, and interest in the app, website, software, source code, design, layout, database structure, systems, features, workflows, names, logos, branding, templates, documentation, and related technology.
You may use the app only as allowed by these Terms.
You may not copy, modify, distribute, sell, lease, sublicense, reproduce, reverse engineer, or create derivative works from any part of the app, software, website, systems, design, branding, or technology without written permission.
Participating organizations retain ownership of content they provide, subject to the permission needed for Community Pulse Hub to display, process, host, store, transmit, and operate that content through the app and related services.
15. Feedback
If you provide ideas, suggestions, comments, or feedback about Community Pulse Hub, you agree that we may use that feedback without restriction, payment, or obligation to you.
16. No Professional Advice
Information in the app is provided for general communication and convenience only.
Community Pulse Hub does not provide legal, financial, medical, emergency, safety, government, public-records, engineering, compliance, or professional advice.
You should contact the appropriate professional, official source, agency, organization, or emergency service when needed.
17. No Warranties
Community Pulse Hub is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, Community Pulse Hub and BrainTech Systems, LLC disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security, and uninterrupted operation.
We do not warrant that the app, website, notifications, content, links, data, or services will be accurate, complete, current, secure, uninterrupted, timely, error-free, or free from harmful components.
18. Limitation of Liability
To the maximum extent permitted by law, Community Pulse Hub, BrainTech Systems, LLC, and their owners, members, managers, officers, employees, contractors, agents, representatives, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost data, loss of goodwill, business interruption, missed notifications, delayed notifications, reliance on information, inability to access the app, service interruptions, device issues, third-party service failures, or unauthorized access.
To the maximum extent permitted by law, the total liability of Community Pulse Hub and BrainTech Systems, LLC for any claim related to the app, website, services, notifications, content, or these Terms will not exceed one hundred dollars ($100.00) or the amount you personally paid directly to Community Pulse Hub for use of the app in the twelve (12) months before the claim, whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
19. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Community Pulse Hub, BrainTech Systems, LLC, and their owners, members, managers, officers, employees, contractors, agents, representatives, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney's fees, arising from or related to:
- Your use or misuse of the app or services.
- Your violation of these Terms.
- Your violation of any law, regulation, contract, community rule, or third-party right.
- Content or information you submit, provide, publish, approve, share, or direct others to publish.
- Unauthorized access to a community, group, account, admin feature, or private access code.
- Your reliance on app content instead of verifying information through official or appropriate sources.
20. Suspension and Termination
We may suspend, restrict, disable, or terminate your access to the app or any feature at any time if we believe you violated these Terms, created risk, misused the service, accessed the app without authorization, or if continued access may harm Community Pulse Hub, BrainTech Systems, LLC, participating organizations, other users, data, systems, or third-party services.
You may stop using the app at any time.
Sections that by their nature should survive termination will continue to apply, including ownership, disclaimers, limitation of liability, indemnification, governing law, and dispute provisions.
21. Updates to These Terms
We may update these Terms from time to time.
When we make changes, we may update the "Last updated" date, post the updated Terms, notify users, or request acceptance of updated Terms inside the app.
Continued use of the app after updated Terms are posted or presented means you accept the updated Terms.
If you do not agree to updated Terms, you must stop using the app.
22. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
To the maximum extent permitted by law, any dispute, claim, or legal action related to Community Pulse Hub, BrainTech Systems, LLC, the app, website, services, notifications, content, or these Terms must be brought in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.
23. Dispute Resolution
Before filing any claim, you agree to contact us first at admin@braintechsystems.com and give us a reasonable opportunity to resolve the issue informally.
Any claim must be brought individually and not as part of a class, collective, consolidated, or representative action, to the maximum extent permitted by law.
Nothing in this section prevents either party from seeking relief in small claims court if the claim qualifies.
24. App Store Terms
If you download or use the app through the Apple App Store, Google Play Store, or another app platform, your use may also be subject to that platform's terms, rules, and policies.
Apple, Google, and other app platforms are not responsible for Community Pulse Hub, app content, support, notifications, claims, or services provided by BrainTech Systems, LLC.
